Authorization and responsibility of the User<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">2.1. The User declares that he has <strong>all rights and authorizations necessary<\/strong> to upload the image to the Platform, including the <strong>express consent of the person shown in the photograph<\/strong>when it is not he same.<br>2.2. When you upload any file, the User grants <strong>felizia.co<\/strong> a <strong>non-exclusive license, free, transferable and sub-licensable<\/strong>, for <strong>use, reproduce, modify, process, and send the image to a third-party technology providers<\/strong>, solely for the purpose of providing the service requested.<br>2.3. The User is <strong>solely responsible<\/strong> the legality and legality of the content that you upload, exonerating <strong>felizia.co<\/strong> any liability arising out of the misuse of the images or data of third parties.<br>2.4. Permitted use of the service<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The User undertakes to use the Platform in accordance with the law, good faith or these Terms.<br>3.2. Intellectual property and image<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. The User retains the rights to the original image that you upload, but gives <strong>felizia.co<\/strong> the rights necessary for your treatment by using AI and for the generation of the Content.<br>4.2. The Generated Content can be processed or rendered by <strong>third-party platforms<\/strong> which act as the <strong>responsible for the treatment<\/strong> and ensure compliance with the european regulations.<br>4.3. The User acknowledges and agrees that the Generated Content is the result of a <strong>automated process, AI<\/strong>, which may involve the use of infrastructure or external models, and that <strong>felizia.co does not guarantee<\/strong> a specific result or its fitness for a particular purpose.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Limitation of liability<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. <strong>felizia.co<\/strong> acts as an intermediary technology and not as a content editor.<br>5.2. In consequence, <strong>felizia.co will not be responsible<\/strong> from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the use by the User or third parties Content Generated;<\/li>\n\n\n\n<li>infringement of image rights, or intellectual property derived from the uploaded files;<\/li>\n\n\n\n<li>damage caused by external providers or failures in the services of IA of third parties.<br>5.3. The service is offered <strong>\u201cas is\u201d<\/strong> (<em>as is<\/em>), without guarantees continuous availability or absence of errors.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Transparency and enforcement of the Regulation of AI (AI Act)<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">6.1. The Platform uses Artificial Intelligence to generate or manipulating visual content.<br>6.2. In compliance with the <strong>Regulation (EU) 2024\/1689 (AI Act)<\/strong>, <strong>felizia.co<\/strong> inform you of ways to be visible when the content has been <strong>generated or altered by IA<\/strong>through labels, or marks (\u201cContent generated by IA\u201d).<br>6.3. The User accepts that the processing of the content may involve <strong>transfer techniques<\/strong> to servers or third party services specialized in AI, always under proper safety measures.<br>6.4. <strong>felizia.co<\/strong> you can deploy digital, metadata and traceability of content to comply with the transparency obligations and prevent illegal uses of the technology.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Protection of personal data<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The treatment of the User's personal data, including the facial image, or any personally identifiable information, is regulated in the <strong><a>Privacy policy felizia.co<\/a><\/strong>.<br>The use of the Platform and uploading content, the User declares to have read and accepted this policy, including the possible data communications to technology providers of confidence for the correct provision of the service.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Deletion of data and content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. The User may at any time request the <strong>removal<\/strong> your original image and\/or Generated Content, to the extent technically feasible.<br>8.2. <strong>felizia.co<\/strong> <strong>will not retain the original images or files generated by more than twenty-four (24) hours<\/strong> since its initial processing, unless the User specifically requests their conservation or there is a legal obligation that requires you to keep them for a longer time.<br>8.3. After this period has elapsed, the files will be deleted automatically and permanent systems <strong>felizia.co<\/strong> and technology providers involved in the processing.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9. Modifications to service<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">9.1. <strong>felizia.co<\/strong> you may modify these Terms or functionalities of the service at any time.<br>9.2. The updated version of the Terms will always be available at <strong>felizia.co\/terms<\/strong> and shall enter into force on the date of its publication.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">10. Applicable law and jurisdiction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms are governed by Spanish law and the relevant european standard.<br>The parties submit to the <strong>courts and tribunals of Santander (Spain)<\/strong>, except where the law provides other jurisdiction required.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">11.
