TERMS OF SERVICE OF THE AFFILIATE PROGRAM FELIZIA.CO

ACCEPTANCE OF AGREEMENT

When you register to be an Affiliate in the Affiliate Program Felizia.co ("Program"), you agree to be bound by the following terms and conditions ("Terms of Service").

Felizia.co reserves the right to update and change the Terms of Service at any time without prior notice. Any new functionality that augment or enhance the current Program, including the release of new tools and resources, shall be subject to these Terms of Service. The continued use of the Program after any such changes shall constitute your consent to the same.

The violation of any of the terms will result in the cancellation of your Account and loss of any affiliate commission will be accumulated. You agree to use the software at your own risk.

1. ACCOUNT TERMS

  • Age: You must be at least 18 years old to participate.

  • Location: There are No geographic restrictions; you can participate from any part of the world, provided that the activity is legal in your jurisdiction.

  • Identity: You must be a human being. Do not allow accounts registered by "bots" or automated methods. You must provide your legal full name, a valid email address and tax information required.

  • Safety: You are responsible for maintaining the security of your account and password. Felizia.co will not be responsible for losses arising from their lack of diligence on the security.

  • Uniqueness: It is not permitted to maintain more than one account per physical or legal person.

  • Fair Use: You may not use the program for any purpose that is unlawful or unauthorized, always complying with the rules of the EU and of your country of residence.

2. LINKS, GRAPHICS, AND FOLLOW-UP

  • Affiliate code: You will be assigned a unique code. You can use the links and banners provided by us following our guidelines.

  • Special Links: For the system to record the sale, you must use the "Special Links" are provided. Felizia.co is not responsible if you or the customer used incorrect links or codes are poorly written, which would result in the non-assignment of the commission.

  • Destination: Links must point directly to the page of the product being promoted.

3. COMMISSIONS, PRICING AND PAYMENTS

  • Eligibility: A sale is eligible when the customer completes the order in https://felizia.co after getting through your Special Link.

  • Modification of Commissions: Felizia.co reserves the right to change the percentages or amounts of the fees at any time. These changes will apply to sales made on or after the date of modification. The specific details of the commission in effect will always be available in the affiliate control panel.

  • Price: The prices of the products are determined solely by Felizia.co according to our internal policies. Because of that the prices may vary, the affiliate must not display a fixed price on your website; it is preferable to indicate that the price should be consulted on the website of Felizia.co.

  • Payment threshold: Los pagos se procesarán únicamente cuando las comisiones acumuladas superen el umbral mínimo aplicable según el tier del afiliado. Si no se alcanza dicho mínimo, el saldo se mantiene para el periodo siguiente. Los umbrales mínimos aplicables se describen en el apartado 3.1.

  • Exclusion of Autocompra: We will not pay commissions for products purchased by the affiliate for their own use or by their own links.

3.1 SISTEMA DE TIERS DEL PROGRAMA DE AFILIADOS

  • Tier 1 — Starter: Aplica a afiliados con entre 0 y 999 ventas acumuladas. Comisión del 30 %. Frecuencia de pago mensual. Pago mínimo para retiro de 10 €.

  • Tier 2 — Active: Aplica a afiliados con entre 1.000 y 2.999 ventas acumuladas. Comisión del 35 %. Frecuencia de pago mensual. Pago mínimo para retiro de 10 €.

  • Tier 3 — Pro: Aplica a afiliados con entre 3.000 y 6.000 ventas acumuladas. Comisión del 40 %. Frecuencia de pago quincenal. Pago mínimo para retiro de 20 €.

  • Tier 4 — Elite: Aplica a afiliados con más de 6.000 ventas acumuladas. Comisión estándar del 45 %. Comisión ampliada de hasta el 50 % en caso de volúmenes mensuales excepcionalmente elevados y previa aprobación expresa por parte de Felizia.co. Frecuencia de pago semanal o según condiciones pactadas individualmente. Pago mínimo para retiro de 20 €.

3.2 BASE DE CÁLCULO DE LAS COMISIONES

  • Las comisiones del Programa de Afiliados se calcularán sobre el margen real obtenido por Felizia.co en cada venta válida, entendiéndose como el importe efectivamente percibido por la empresa una vez deducidos los siguientes conceptos.

  • Impuestos indirectos aplicables (incluyendo, sin limitación, IVA u otros tributos similares).

  • Comisiones y cargos de pasarelas de pago o entidades financieras (incluyendo, sin limitación, Stripe, Alipay, WeChat Pay, tarjetas bancarias, transferencias u otros medios de pago).

  • Costes directos de generación del vídeo o del servicio contratado, con independencia de la tecnología utilizada.

  • Gastos técnicos u operativos imprescindibles para la prestación del servicio.

  • El porcentaje de comisión correspondiente al tier aplicable se calculará exclusivamente sobre dicho margen.

  • Felizia.co no estará obligada a revelar al afiliado el desglose interno detallado de dichos costes, sin perjuicio de que el afiliado pueda consultar en su panel el importe final acreditado por cada venta.

3.3 POLÍTICA DE REENTREGA Y AUSENCIA DE DEVOLUCIONES AUTOMÁTICAS

  • Dado el carácter digital y personalizado del servicio, una vez iniciado el proceso de generación del vídeo no existirá derecho automático de reembolso.

  • No obstante, en caso de resultado defectuoso o insatisfactorio derivado de errores técnicos o limitaciones de los sistemas de generación, Felizia.co podrá, a su sola discreción, generar un nuevo vídeo sin coste adicional para el cliente o proceder al reembolso del importe abonado.

  • En caso de reembolso, la venta no generará comisión para el afiliado o, si ya hubiera sido acreditada, será descontada del saldo pendiente.

4. IDENTIFICATION AND RELATIONSHIP BETWEEN THE PARTIES

  • Independence: You and Felizia.co are independent contractors. This agreement does not create any relationship of partnership, franchise, sales representative, or employment relationship.

  • Transparency: You may not issue press releases or misrepresent your relationship with us. Can't say that it is part of the company or that we develop products together.

  • Disclosure: In accordance with the regulations of the EU, the member must clearly inform its users that receive compensation for sales generated (Notice of Affiliation).

5. RESPONSIBILITIES AND LEGAL COMPLIANCE

  • Operation of the site: You are solely responsible for the technical maintenance of the website and of the veracity of the materials that you post.

  • RGPD (Data Protection): You must strictly comply with the General Regulation of Data Protection (EU) 2016/679. This includes cover in your Privacy Policy regarding the use of third party cookies and tracking of affiliate.

  • Ethical Marketing: It is strictly prohibited to send emails, unsolicited commercial emails (SPAM) under the Law 34/2002 (LSSI-CE). All communication must comply with Spanish regulations of electronic commerce.

6. DURATION, TERMINATION AND LIMITATION OF LIABILITY

  • Duration: The agreement begins with the acceptance of your application and ends when either party gives notice of termination in writing.

  • Suspension: Felizia.co may terminate your account for any reason (especially by methods of aggressive sales, fraudulent or questionable) resulting in the loss of commissions pending.

  • Limitation: Felizia.co will not be liable for any consequential damages or loss of income related to this agreement. Our total liability will not exceed the commissions paid or payable to you.

  • Warranties: We do not warrant that the operation of Felizia.co will be uninterrupted or error-free.

7. DISPUTE RESOLUTION

  • Applicable Law: This Agreement shall be governed by and construed in accordance with the laws of Spain.

  • Arbitration: Any dispute relating to this Agreement shall be submitted to confidential arbitration in the city of Santander, Cantabria, under the rules of the arbitration system in force in Spain.

  • Jurisdiction: In case not be settled by arbitration, both parties agree to submit to the exclusive jurisdiction of the Courts and tribunals of the city of Santander, expressly waiving any other jurisdiction that may correspond to them.

8. PROTECTION OF PERSONAL DATA OF THE AFFILIATE

  • In accordance with the provisions of the RGPD, we inform you that your personal data will be processed by Felizia.co to manage your participation in the program. You can exercise your rights of access, rectification and deletion by sending an email to our support team.
