2. Purpose of the treatment

In felizia.co we treat the personal data of the User for the following purposes:

  1. Provision of the service of the generation of images or videos using artificial intelligence (AI).
    • The User upload a image and the platform generates a visual content tampered with or derived (“Generated Content”).
    • This treatment includes the sending of temporary files to external providers of infrastructure and rendering AI, needed to run the process.
  2. Management of the relationship with the User.
    • Attention to inquiries or incidents.
    • To send information on upgrades or maintenance service.
  3. Safety and regulatory compliance.
    • Prevention of illicit uses, abuses of the system or breach of third party rights.
    • Compliance with legal obligations arising from the RGPD, LOPDGDD and AI Act.

3. Legitimation of the treatment

The treatment of the personal data of the User is based on the following legal bases:

  • Performance of a contract: the processing is necessary to provide the requested service (art. 6.1.b RGPD).
  • Express consent: the User authorizes the use and treatment of your image, as well as the sending of temporary files to external providers of AI (art. 6.1.to RGPD).
  • Compliance with legal obligations.: in the matter of data protection, transparency and traceability of the content generated by AI (art. 6.1.c RGPD and AI Act).

4. Data processed

To provide the service, felizia.co it may process the following data:

  • Image or media file provided by the User.
  • Technical metadata associated with the processing of the image (size, format, date of the upload).
  • IP address and data connection (required for the operation of the service).
  • E-mail or session id (if the User is logged in or communicates).

felizia.co does not request or sensitive data other than those that are strictly necessary to generate the content.

5. Assignment and transfer of data to third parties

5.1. To be able to run the service, felizia.co may communicate the temporary files, and data to technology providers trusted that provide the infrastructure for processing or rendering of AI.
5.2. These service providers act as responsible for the treatmentin accordance with article 28 of the RGPD, and only process the data according to instructions felizia.co.
5.3. When the servers of these providers are located outside of the European Economic area, we will ensure an adequate level of protection by the signature of standard contractual clauses approved by the European Commission.
5.4. felizia.co does not sell or lease personal information to third parties for commercial or advertising purposes.

6. Period of conservation

  • The original images and the generated files will be automatically deleted within a maximum period of twenty-four (24) hours since its initial processing, unless the User specifically requests their conservation or there is a legal obligation that requires you to keep them for a longer time.
  • Technical records or metadata (logs, ids, server errors) may be retained for a maximum period of 30 days for the purposes of security and maintenance.
  • The data of contact or communications with the User will be kept as long as there is a contractual relationship or until you request its suppression.

7. User's rights

The User may at any time exercise the following rights, provided for by the RGPD:

  • Right of access: know what personal data is being treated.
  • Right of rectification: to request the correction of inaccurate data.
  • Right to erasure (“right to be forgotten”): request deletion of the personal data, including the image uploaded.
  • Right of opposition: oppose to certain treatments.
  • Right to the limitation of the treatment: request to temporarily suspend the use of your data.
  • Right to portability: to receive the data in structured format.

To exercise these rights, the User may send an email to privacidad@felizia.co, indicating the right you want to exercise and identifying properly.
You may also submit a claim to the Spanish agency of Data Protection (AEPD) if it considers that the treatment does not conform to the rules.

8. Information security

felizia.co applies technical and organisational measures to protect personal data against loss, alteration, unauthorized access or disclosure.
These measures include:

  • Automatic removal of images within 24 h.
  • Encryption of transmissions and temporary storage.
  • Access restricted to authorized personnel.
  • Monitoring technology providers under contracts of treatment of data.

9. Transparency and content created by AI

9.1. felizia.co used technologies of artificial intelligence to generate and manipulate images, and videos uploaded by User.
9.2. In compliance with the Regulation (EU) 2024/1689 (AI Act)the content generated by AI may be labelling or marking digitally as the “Content generated by artificial intelligence.”
9.3. The User consents that their image may be treated by means of automatic processes of AI with this purpose.

10. Policy updates

felizia.co you may modify this Privacy Policy at any time, for legal reasons or techniques.
The updated version will always be available at https://felizia.co/privacidad and shall enter into force from their publication.
The User is encouraged to periodically review this page.
