2. Authorization and responsibility of the User
2.1. The User declares that he has all rights and authorizations necessary to upload the image to the Platform, including the express consent of the person shown in the photographwhen it is not he same.

3. Permitted use of the service

4. Intellectual property and image
4.1. The User retains the rights to the original image that you upload, but gives felizia.co the rights necessary for your treatment by using AI and for the generation of the Content.
4.2. The Generated Content can be processed or rendered by third-party platforms which act as the responsible for the treatment and ensure compliance with the european regulations.
4.3. The User acknowledges and agrees that the Generated Content is the result of a automated process, AI, which may involve the use of infrastructure or external models, and that felizia.co does not guarantee a specific result or its fitness for a particular purpose.
5. Limitation of liability
5.1. felizia.co acts as an intermediary technology and not as a content editor.
5.2. In consequence, felizia.co will not be responsible from:
- the use by the User or third parties Content Generated;
- infringement of image rights, or intellectual property derived from the uploaded files;
- damage caused by external providers or failures in the services of IA of third parties.
5.3. The service is offered “as is” (as is), without guarantees continuous availability or absence of errors.
6. Transparency and enforcement of the Regulation of AI (AI Act)
6.1. The Platform uses Artificial Intelligence to generate or manipulating visual content.
6.2. In compliance with the Regulation (EU) 2024/1689 (AI Act), felizia.co inform you of ways to be visible when the content has been generated or altered by IAthrough labels, or marks (“Content generated by IA”).
6.3. The User accepts that the processing of the content may involve transfer techniques to servers or third party services specialized in AI, always under proper safety measures.
6.4. felizia.co you can deploy digital, metadata and traceability of content to comply with the transparency obligations and prevent illegal uses of the technology.
7. Protection of personal data
The treatment of the User's personal data, including the facial image, or any personally identifiable information, is regulated in the Privacy policy felizia.co.
The use of the Platform and uploading content, the User declares to have read and accepted this policy, including the possible data communications to technology providers of confidence for the correct provision of the service.
8. Deletion of data and content
8.1. The User may at any time request the removal your original image and/or Generated Content, to the extent technically feasible.
8.2. felizia.co will not retain the original images or files generated by more than twenty-four (24) hours since its initial processing, unless the User specifically requests their conservation or there is a legal obligation that requires you to keep them for a longer time.
8.3. After this period has elapsed, the files will be deleted automatically and permanent systems felizia.co and technology providers involved in the processing.
9. Modifications to service
9.1. felizia.co you may modify these Terms or functionalities of the service at any time.
9.2. The updated version of the Terms will always be available at felizia.co/terms and shall enter into force on the date of its publication.
10. Applicable law and jurisdiction
These Terms are governed by Spanish law and the relevant european standard.
The parties submit to the courts and tribunals of Santander (Spain), except where the law provides other jurisdiction required.
11. Acceptance
The User declares to have read, understood and accepted in full these Terms and Conditions carefully before using the Platform or upload any file to felizia.co.
